The use of services from DPWeb Group LLC and/or DPWebGroup.com [hereafter referred to as “DPWeb” , “We” , “Us”, “Our”, etc…] constitutes agreement to these terms.
1. New Accounts
You will receive login information for your hosting account once we receive payment and screen it for fraud. You must provide a valid email address that you can be contacted at in case there is a payment or technical issue.
Ultimately it is your responsibility to ensure contact information is correct for your DPWebGroup billing account and for your domains whether they are registered at DPWebGroup.com or another domain registrar.
If you need to verify anything about your account, please submit a support ticket.
2. Transfers
Sometimes DPWeb will offer free or paid transfers depending on the circumstances. DPWeb Group LLC is in no way shape or form responsible for any lost data in the case of a transfer. It is your responsibility as a website owner to download and maintain current backups. We will do everything in our power to ensure there is a successful transfer, but sometimes technical difficulties are unavoidable.

3. Renewal / Suspension
You will be sent 3 overdue notices before your account is suspended. If the invoice for your hosting or domain renewal is not paid within 30 days of its due date, you risk the opportunity of having your account temporarily suspended until the invoice is paid. This is why it is so important to maintain current contact information.
Domain renewals are billed and renewed 30 days before the renew date. It is the customer’s responsibility to notify our sales team via support tickets for any domain registration cancellation. No refunds can be given, once a domain is renewed. All domain registrations, and renewals are final.
4. Spam Policy
We take a zero tolerance stance against sending of unsolicited e-mail, bulk emailing, and spam. “Safe lists” and purchased lists will be treated as spam. Any user who sends out spam will have their account terminated with or without notice.
Sites advertised via SPAM (Spamvertised) may not be hosted on our servers. This provision includes, but is not limited to SPAM sent via fax, phone, email, instant messaging, or usenet/newsgroups. No organization or entity listed in the ROKSO may be hosted on our servers. Any account which results in our IP space being blacklisted will be immediately suspended and/or terminated.
DPWeb reserves the right to require changes or disable as necessary any web site, account, database, or other component that does not comply with its established policies, or to make any such modifications in an emergency at its sole discretion.
DPWeb reserves the right to charge the holder of the account used to send any unsolicited e-mail a clean up fee or any charges incurred for blacklist removal. This cost of the clean up fee is entirely at the discretion of DPWeb.
5. Payment Information
Before DPWeb is required to provide any services, accurate payment information must be supplied. You agree to provide accurate billing information even in the event of a free trial service.
You also agree to reoccurring payments that will continue to be invoiced until a service is cancelled. If payment is made outside of the grace period and an account is suspended, payment will still be expected for the time the account spent suspended. Please submit a support ticket if you have any questions about this policy.
If you would like to pause service on your hosting account, you must submit a support ticket so we can cancel service and suspend your account for the time you want. If we know this ahead of time, we can allocate resources properly.
Invoices that have been paid more than once with multiple Paypal Subscriptions can only be added as credit towards the account and cannot be refunded via Paypal. If you require assistance with this provision, please contact us via support ticket if you have any questions.
We reserve the right to change the monthly payment amount and any other charges at any time.
6. Cancellation
We reserve the right to cancel, suspend, terminate, or restrict access to any hosting account at any time regardless of warning.
To cancel your account, please submit a support ticket to begin the verification process.
Any abuse of our server, web systems, database, or staff will result in suspension and possibly termination or legal action.
7. Refunds
We reserve the right to refund at a prorated amount or none at all depending on the circumstances. Refunds must be requested within the first 30 days.
Customers may cancel at any beginning with a support ticket. You can be refunded for the amount of time left on your paid billing cycle within the first 30 days. If you received a discount, you will receive a prorate amount of the discounted amount.
If you received free hosting as part of a service or website sale, you are not eligible for a refund on your hosting account until you start your first paid billing cycle.
There are no refunds for administration fees on, but not limited to: domain registrations, renewals, transfers, mobile sites, IP addresses, web design, or SSLs.
There are no refunds for deposits on SEO, Social Media, Pay-Per-Click, Email Marketing, Mobile Web Sites, or Web Design services
Violations of the Terms of Service or any other agreement warrant automatic suspension, or termination without refund.
8. Shared Hosting Resource Usage
You are bound to the resources given to your account and displayed in your cpanel account. If you start to near your resource limit, you will be contacted to make an upgrade or risk service interruption.
Users may not user more than 25% of the server resources for more than 95 seconds. You may not run any type of spider or indexer or stand alone server side processes.
You may not participate in any file sharing activies or peer to peer services. Bittorrents are strictly prohibited.
You may not run gaming servers on shared hosting accounts.
Cron entries should not be in smaller increments than 15 minutes, and should be increased in between MySQL queries if possible. If your resource usage is above 25% for more than 95 seconds at a time, you will be contacted to upgrade your hosting account depending on the amount of resources you are using, and the nature of the program.
Only use secure protocol for necessary services since it is noticeably intensive for CPU usage and can use more than 25% of your resources for longer than 95 seconds.
If you use more than 75,000 inodes, you will be sent a warning and asked to clean up what you can and delete or download old un necessary files. At 100,000 Inodes you will be asked to upgrade to a VPS.
9. Communication from DPWeb Group LLC
We may occasionally email you at the email address provided by you at registration to update you on important information regarding your account, our service, and training and support materials which could help you use our service better. These emails are required because it could impact you in a number of ways not limited to: the price you pay, future prices of products, important services you need to know about, maintenance or service outages.
10. Disclosure to Law Enforcement
We will disclose any customer information to law enforcement agencies without consent or notice upon lawful request from such agencies. We will never give out or pass out your information to anyone without legal documentation that they are to look at it.
11. Disclaimer
We are not responsible for any damage to your business or your revenue. We make no warranty or guarantee of service and are not responsible for any damages to your business or brand during downtime or technical difficulties.
We are also not responsible for any loss of data or interruption of service. You are ultimately responsible for downloading and maintain current and accurate back ups of all of your website files and databases.
12. AdWords Coupons
Adwords Coupon Codes will not be distributed to new clients until after the first invoice payment above $0.00.
13. Email Marketing
All email marketing services must be used for completely legal services. DPWeb Group LLC and its owners assume no responsibility for the misuse of the system or the loss of business that incurs for the client in case of account suspension.
SPAMing is strictly prohibited under all circumstances. Sending unsolicited email messages will result in a termination of your account without refund.
CAN SPAM COMPLIANT FOOTER REQUIREMENT
You must have a footer in every email message that includes:
1. A Visible Unsubscribe Link
2. Your Company’s Address
3. A Link to Your Privacy Policy
Payments for email marketing service are due on the due date. Failure to pay on time can result in automatic suspension of services. Invoices are sent out 1-2 weeks in advance to ensure ample time to make payment.
Backing up your emails and subscriber list regularly is recommended. DPWeb Group will not be held responsible in the case of a loss of this data. Under no circumstances will DPWeb Group be held responsible for the loss of any, but not limited to: data, content, images, files, emails, subscribers, contact information, and anything else kept inside of any DPWeb Group Email Marketing account.
14. Back ups
Customers will be responsible for taking back ups of their cpanel account and files. DPWeb Group will not be held responsible for the loss of any but not limited to: data, content, images, files, emails, subscribers, contact information, and anything else kept inside of any DPWeb Group Account of any kind.
15. Changes to the Terms of Service
We reserve the right to revise the policies in this document and our website at any time without notice.
